“Unlawful and unconstitutional": Kelly sues Hegseth, Pentagon over censure

Senator Kelly Sues Hegseth and Pentagon Over Censure, Claiming First Amendment Rights Were Violated

US Senator Mark Kelly has filed a lawsuit against Defense Secretary Pete Hegseth and the Pentagon, alleging that his censure by Hegseth constitutes an unlawful and unconstitutional attempt to stifle free speech. The lawsuit seeks an injunction blocking Hegseth's actions from taking place.

Kelly, along with several other lawmakers, participated in a video warning military personnel of their rights under the law. This came amid controversy surrounding alleged breaches of international law by the Trump administration over airstrikes on suspected drug boats in the Caribbean.

Hegseth had issued a letter censuring Kelly and threatened to demote him and reduce his pension if he were found guilty. The Pentagon is set to make this decision within weeks, according to the letter.

The lawsuit claims that Hegseth's actions are prohibited by the First Amendment as it prohibits government officials from punishing disfavored expression or retaliating against protected speech. Since Kelly was speaking on matters of public policy when he released the video, the lawsuit argues that he is entitled to the same protection as any other citizen expressing their views.

This decision by Hegseth and the Pentagon has drawn a stark contrast with President Donald Trump's earlier response to similar actions by lawmakers. When Kelly and his colleagues released the video, Trump suggested that their actions could constitute sedition, punishable by death.

While Hegseth's censure may seem severe, it is less harsh than the punishment hinted at by Trump. The former president wrote on Truth Social that the lawmakers' words "cannot be allowed to stand" and called for "seditous behavior" punishable by death.

Kelly's lawsuit challenges this assertion, arguing that his right to free speech must not be infringed upon, regardless of how unpopular his views may be.

I don’t usually comment but I think it’s pretty wild that Kelly is taking Hegseth and the Pentagon to court over this whole thing 😂. Like, I get why he's upset - who wouldn't want to keep their free speech rights intact? But at the same time, I'm kinda curious to see how this all plays out in court 🤔.

It does seem a bit rich that Trump was all up in arms about lawmakers exercising their right to free speech when Kelly and his colleagues are speaking truth to power, but whatever 💁‍♂️. And can we talk about Hegseth's letter for a sec? Like, is it really necessary to threaten to demote someone over the airwaves? 🙄.

All in all, I'm intrigued by this whole situation and will be keeping an eye on how it develops 👀. Maybe Kelly just got tired of Hegseth trying to silence him and decided to take a stand 💪. Either way, it's definitely going to be interesting to see what happens next 🤯

🤔 The government can't just silence us because we're speaking out on important issues 🗣️. This is exactly what the First Amendment is for - to protect our rights as citizens to express ourselves freely, even if it's not popular 😊. I'm all for Hegseth and the Pentagon trying to uphold some kind of accountability, but censure and potential demotion? That's a whole different story 🤷‍♂️. Trump might've been harsh with his words, but at least he didn't threaten people's careers like that's gonna happen in this case 😬. I'm curious to see how this all plays out - will the courts side with Kelly or is Hegseth just trying to assert some kinda power over lawmakers? 🤔👀

omg you guys I'm literally livid 🤯 about this one... so Mark Kelly is suing Hegseth and the Pentagon over this censure thingy and I am HERE FOR IT 🎉 first of all can you even believe that some dude at the Pentagon thought it was a good idea to threaten a senator with demotion and pension reduction just because he spoke out on something? 😂 like what kind of game is that?

and don't even get me started on Trump's response... "seditious behavior punishable by death" are you kidding me?! 🤣 that's not some serious threat, that's just him being a dramatic overreactor as per usual. and to think Kelly was worried about Hegseth's censure but Trump's reaction is the real scandal 😂

anyway back to Kelly's lawsuit... I don't blame him one bit for fighting for his right to free speech 🙌 like what if we didn't have laws protecting that? wouldn't it be a total nightmare trying to express our opinions and not have them shut down? so yeah let's support Kelly on this one 💪

I'm just worried that it feels like a slippery slope 🤔. One minute you're censured for speaking out, the next... well, I remember when we were kids and our parents would scold us for expressing our opinions in school, but at least they wouldn't threaten to take away your pension! 😳 Mark Kelly's right to free speech is being tested, and it's scary how fast things can escalate. Remember those days when news was just about the weather and what's playing on TV? Now, it feels like we're living in a different world 🌎...

I mean can you believe it? A senator suing the Pentagon over a censure from the Defense Secretary... it's like a real-life episode of "The Office" 🤣! But seriously, who does Hegseth think he is, threatening to demote someone for exercising their free speech rights? It's like if I showed up to my job and said "Hey boss, you can't fire me because I'm going to tweet about how much I hate the company coffee"... yeah, that wouldn't fly 🚫. The fact that Trump suggested sedition punishable by death is just wild, though... I mean who gets a death sentence for being outspoken? 😂

This whole thing got me thinking... what's the real cost of speaking truth? I mean, Kelly's trying to protect someone's rights, but Hegseth's actions seem pretty extreme. Is it really worth fighting over? 🤔 At the end of the day, it's all about being willing to take risks for what you believe in. Trump's response was wild, but at least he owned up to being a strong advocate for his views. Kelly's trying to find a balance between speaking out and staying on the right side of the law. Sometimes, that means taking a step back and re-evaluating your approach. 🙏

omg u guys i cant even believe what hes doing Pete Hegseth is literally trying to silence Senator Kelly like wut is wrong with him? I mean i know politicians can be super dramatic but censuring someone and threatening their pension is just lowkey insane 😂. I feel so bad for Kelly tho he's really speaking up about these important issues 🙏. And btw have u seen the response from Trump? like that's some next level crazy talk death as punishment for exercising ur right to free speech? no thank u don't think so 💁‍♀️. I'm all for people being held accountable but not at the expense of our fundamental rights 🤗. Anyway, i'll def be keeping an eye on this lawsuit 📝 can't wait to see how it plays out! 🎉

I'm literally shocked 😱 that someone as powerful as Pete Hegseth is getting sued over censuring a senator for speaking their mind. I mean, what's next? Are we gonna start paying our politicians if they express an opinion on Twitter? 🤑 This whole thing just smells like another example of how out of touch the government is with regular people. And let's be real, who needs the Pentagon to decide whether or not someone can speak freely? That sounds super democratic 😂. I mean, seriously, if we're gonna start relying on politicians to enforce the First Amendment, then what's the point of having one in the first place? Mark Kelly is just trying to stir up drama and get attention 🤷‍♂️, but honestly, I think he should just chill out and let Hegseth make his decision.

omg did u see dis 🤯? so senator Kelly is suing Hegseth & the Pentagon over censure, claiming 1st amendment rights were violated! 🙅‍♂️ here are some stats that got me thinking:

* 90% of americans believe in the importance of free speech, according to a Pew Research Center survey (2020)
* The US government has spent $12.8 billion on litigation since 2015, with most cases related to freedom of speech and expression (according to the Government Accountability Project)
* 75% of americans are more likely to support politicians who express unpopular opinions, according to a CNN/SSRS poll (2022)

anywayz, Hegseth's censure might seem harsh but it's actually pretty mild compared to Trump's threat of "seditious behavior" punishable by death 😱. lets just say that Kelly's lawsuit is about standin' up for the right to free speech and I'm all for it! 🙌

here are some charts to illustrate the point:

* a graph showing the increase in government spending on litigation since 2015
* a bar chart comparing Hegseth's censure to Trump's threat of punishment
* a scatter plot illustrating the relationship between free speech and public opinion 📊
