“Unlawful and unconstitutional": Kelly sues Hegseth, Pentagon over censure

Senator Kelly Sues Pentagon Over Censure, Claims First Amendment Rights Have Been Violated

A lawsuit has been filed against Defense Secretary Pete Hegseth and the Pentagon by Arizona Senator Mark Kelly, who claims that his censure is "unlawful and unconstitutional." Kelly, along with several other lawmakers, released a video in November discussing their rights as military personnel to refuse unlawful orders. The video was seen as a response to accusations that the Trump administration had violated international law in carrying out airstrikes on suspected drug boats in the Caribbean.

Hegseth's censure was issued after the release of the video, and he announced that the Department of Defense would decide whether to demote Kelly and reduce his pension. However, Kelly is now seeking a court order to block Hegseth and the Pentagon from taking any further action.

Kelly's lawsuit argues that the First Amendment protects legislators' right to express their views on matters of public policy without fear of retaliation or punishment. The senator claims that Hegseth's move constitutes an "unlawful and unconstitutional" attempt to punish his speech.

In contrast, President Donald Trump has taken a more extreme stance, suggesting that Kelly and other lawmakers who released the video might be committing sedition, which is punishable by death. While Hegseth's censure may seem severe, it is relatively mild compared to the threat posed by Trump's rhetoric.

The lawsuit filed by Kelly marks an important test of the limits of First Amendment protections for public officials. As the case makes its way through the courts, it will be crucial to determine whether lawmakers are entitled to absolute freedom from punishment in exchange for their expression of views on matters of public policy.

I don't know how this is gonna play out 🤔... so many questions surrounding free speech and government power. On one hand, I get why Kelly wants to fight this - the First Amendment is a fundamental right, after all 🙌. But at the same time, Hegseth's censure seems like a reasonable response to Kelly's actions in releasing that video 💪... I mean, you can't just go around criticizing military policies without consequences, right? And then there's Trump's whole sedition thing 😱... that's a whole different level of crazy. Anyway, this case is gonna be super interesting to watch 📺... will the courts side with Kelly or uphold Hegseth's actions? Only time (and some serious legal analysis) will tell 🤷‍♂️

omg can you believe what's going on 🤯?! senator kelly is suing the pentagon over being censured and he's saying it's a violation of his first amendment rights 🙅‍♂️ i mean, i get where he's coming from - freedom of speech is super important especially when it comes to public figures like lawmakers. but at the same time, i'm not sure if kelly's stance is completely reasonable either? i think there's a gray area here and the courts are gonna have to weigh in on this one 🤔. anyway, i hope senator kelly gets justice (and that trump stops making crazy comments lol) 💪

🤔 This is getting pretty interesting. I'm not sure if I agree with Kelly's stance here, but I do think his right to free speech should be protected. However, at the same time, as a lawmaker, he did break some rules by releasing that video without consulting his party leadership first... that was a bit reckless of him 🙄. Trump's comments though, are straight-up concerning - sedition is a serious charge and it's not something to be taken lightly 😬. I'm watching this case with bated breath to see how the courts rule out. It feels like there's going to be some major implications for lawmakers' ability to speak out on issues they care about 💥

🤔 This whole thing is kinda wild... like, I get why Kelly wants to sue, but at the same time, you gotta wonder what he's hoping to achieve here? Does he really think a court order is gonna protect him from, like, actual consequences for his actions? 🙄 And what about all those people who might be offended by Kelly's views? Shouldn't that count for something?

I mean, I'm no expert, but it seems to me that if you're gonna express an opinion, especially on something as serious as war, then you gotta deal with the fallout. It's not like there's a get-out-of-jail-free card just because you're a senator. 🤷‍♂️ And Trump's whole sedition thing? That's just crazy talk... or at least, it should be! 😂

🤔 I don't get why Kelly is making such a big deal about this censure thingy... like, isn't he just saying what the rest of us think? And now he's suing the Pentagon over it? 🤑 It seems like a pretty weak lawsuit to me, but I guess we'll see how it plays out in court. One thing that does have me worried is if Trump's words are really that serious... I mean, sedition punishable by death? 😱 That just sounds super extreme and scary. Maybe Kelly's right that the First Amendment has some limits, but Trump's words seem like a bridge too far. 🚨

I'm so done with these politicians and their lawsuits 🙄. Like seriously, Senator Kelly sues Pentagon over censure because he thinks he's being punished for speaking out? Newsflash, senator: if you don't like the scrutiny, maybe don't be so vocal about it 🤦‍♂️. And now President Trump is threatening to label them as seditionists? That's just crazy talk 😩. I mean, come on, what's next? Censoring politicians because they can't handle criticism? It's like, we're not living in a dictatorship here, folks 🙅‍♂️. The First Amendment protects us from the government silencing us, but it doesn't protect politicians from facing consequences for their actions...or lack thereof 😒.

🤔 I dont really get why Kelly is so upset about being censured... like, isn't that what happens when you do something wrong? 🙄 He's saying it's unconstitutional but isn't censure just a way to say "oh no you didn't do that right"? 😐 And then Trump is going all out and calling them seditionists... what's up with that? 🤯 I think its time for some clarification on this, like, can someone explain to me what sedition even means in this context?

😒 I mean, who wouldn't want to sue the Pentagon over being censored? It's not like you're just another politician looking for a way to get attention or anything 🙄. Mark Kelly's trying to claim that his First Amendment rights are being violated, but let's be real, he's probably just mad because someone dared to disagree with him 🤷‍♂️.

And what's up with Trump's sedition threat? Is he for real? 🤣 I mean, it's not like Kelly and the other lawmakers were threatening to overthrow the government or anything 😂. It's all about "fearless truth-telling" and "standing up for what you believe in"... code for "I'm going to make a scene and get my name in the papers".

I'm thinking this is gonna get super interesting in court 🤔. Did you know that the First Amendment was ratified in 1791 and has been amended only once, back in 1992? 📜 Anyways, I did some research on Senator Kelly's lawsuit and here are some stats:

* 76% of Americans support the First Amendment, according to a recent Gallup poll 🤝
* The Pentagon has a huge budget, $721 billion for FY2023 🤑 But did you know that's less than half of what NASA got in FY2022? 🚀
* In terms of the Trump administration's airstrikes on suspected drug boats, here are some numbers:
+ 11 airstrikes were conducted between Oct 2017 and March 2019 ⏰
+ An estimated 1,000-3,000 civilians may have been killed or injured in those strikes 🤯

It's gonna be interesting to see how this case plays out! Stay tuned for updates 📺

🤔 I think this is getting crazy lol. Like what's next? Are they gonna sue each other or something 🙄? Anyway, imo Kelly's got a point about First Amendment rights but I'm not sure if it's gonna be enough to block Hegseth and the Pentagon from taking action 💯. Trump's comments though? 😱 that's just nuts. Can't believe he's even suggesting sedition as an option 🙅‍♂️. Anyway, this lawsuit is definitely gonna be a wild ride to watch 👀
